These Terms and Conditions (“Terms”) govern your use of rental, leasing, and property management services provided by Sohum Realty, operating in the State of Illinois, USA. Please read these Terms carefully before entering into any agreement with us. By signing a lease or engaging our services, you acknowledge that you have read, understood, and agree to be bound by these Terms.

1. Acceptance of Terms

By accessing or using the services provided by Sohum Realty (“Company,” “we,” “us,” or “our”), including property rental, leasing, and property management services in the State of Illinois, you (“Tenant,” “Owner,” “Client,” or “User”) agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, you may not use our services.

These Terms apply to all clients, tenants, property owners, and any other parties who interact with Sohum Realty in connection with rental or property management services.

2. Services Provided

Sohum Realty provides the following services in Illinois:

  • Residential and commercial property rental and leasing
  • Full-service property management including rent collection, maintenance coordination, and tenant screening
  • Lease preparation, renewal, and termination assistance
  • Move-in and move-out inspections
  • Compliance with Illinois Residential Landlord and Tenant Act (RLTA) and applicable local ordinances

All services are subject to a separate written agreement or lease executed between the parties.

3. Eligibility & Application

To be eligible for rental services, applicants must:

  • Be at least 18 years of age
  • Provide valid government-issued photo identification
  • Complete and submit a rental application with signed consent for credit and background checks
  • Meet income, credit, and rental history requirements as specified per property

Submission of an application does not guarantee approval or tenancy. Sohum Realty reserves the right to deny any application in accordance with applicable fair housing laws.

4. Lease Agreement

All tenancies are governed by a written Lease Agreement signed by all parties. The Lease Agreement constitutes the primary binding contract between the tenant and property owner. These Terms and Conditions serve as a supplement to, and do not replace, the Lease Agreement.

Standard lease terms are 12 months. Month-to-month, 6-month, and 18-month options may be available at adjusted rates. All lease modifications must be made in writing and signed by authorized representatives of Sohum Realty.

5. Rent & Payment Terms

Rent is due on the 1st of each month unless otherwise specified in your Lease Agreement. A grace period may apply as stated in the lease. Late fees will be assessed in accordance with Illinois law (765 ILCS 710) and as specified in your lease.

Accepted payment methods include ACH bank transfer, certified check, money order, and approved online payment portals. Personal checks may be accepted during the tenancy at management’s discretion. All move-in funds must be paid via certified check, money order, or ACH transfer.

6. Security Deposit

Security deposits are collected in accordance with the Illinois Security Deposit Return Act (765 ILCS 710) and the Illinois Security Deposit Interest Act (765 ILCS 720). The deposit amount, typically equal to one to two months’ rent, is specified in the Lease Agreement.

Security deposits are held in a federally insured interest-bearing account. Upon termination of tenancy, deposits will be returned within 30 days (or 45 days if deductions are itemized) along with an itemized statement of any deductions. Deductions may be made for unpaid rent, damages beyond normal wear and tear, cleaning, or other lease violations.

7. Maintenance & Repairs

Sohum Realty is committed to maintaining properties in habitable condition as required by Illinois law. Tenants must promptly report maintenance issues through our designated maintenance request portal or by contacting our office in writing.

Tenants are responsible for routine upkeep including replacing light bulbs, maintaining cleanliness, and preventing damage caused by negligence. Emergency maintenance (loss of heat, flooding, gas leaks) will be addressed within 24 hours. Non-emergency repairs will be scheduled within a reasonable timeframe. Landlord entry for repairs requires a minimum of 24 hours advance written notice under Illinois law.

8. Tenant Responsibilities

Tenants agree to:

  • Pay rent on time and in full as specified in the Lease Agreement
  • Maintain the property in clean and sanitary condition
  • Not engage in illegal activity on the premises
  • Comply with all community rules, HOA regulations, and local ordinances
  • Carry renter’s insurance with a minimum of $100,000 personal liability coverage, naming Sohum Realty as an additional interested party
  • Not sublease, assign, or allow unauthorized occupants without prior written approval
  • Report maintenance issues promptly to prevent further damage

9. Pet Policy

Pets are permitted only in properties designated as pet-friendly and only with prior written approval. A non-refundable pet fee and/or monthly pet rent may apply. Breed and weight restrictions may be in effect. All pets must be disclosed on the rental application.

Service Animals and Emotional Support Animals are handled in accordance with the Fair Housing Act and Illinois Human Rights Act. Please contact our office with appropriate documentation prior to move-in.

10. Termination & Early Lease Break

Tenants wishing to vacate at lease end must provide written notice as specified in the Lease Agreement (typically 30–60 days). Failure to provide proper notice may result in forfeiture of the security deposit or liability for additional rent.

Early lease termination may result in financial liability for remaining rent until the unit is re-rented. Exceptions include: active military deployment (Servicemembers Civil Relief Act), domestic violence (765 ILCS 720 — Safe Homes Act), uninhabitable conditions, or mutual written agreement. Early termination fees, if applicable, are specified in your lease.

11. Fair Housing & Non-Discrimination

Sohum Realty is committed to full compliance with the Federal Fair Housing Act and the Illinois Human Rights Act. We do not discriminate on the basis of race, color, national origin, religion, sex, disability, familial status, sexual orientation, gender identity, marital status, age, military status, or source of income.

If you believe you have been subject to discriminatory treatment, you may file a complaint with the U.S. Department of Housing and Urban Development (HUD) or the Illinois Department of Human Rights (IDHR).

12. Limitation of Liability

Sohum Realty shall not be liable for any indirect, incidental, special, or consequential damages arising from the use of our services, including but not limited to loss of property, personal injury, or financial loss, except where required by Illinois law.

Our total liability for any claim shall not exceed the total fees paid by the client to Sohum Realty in the three months preceding the claim. Nothing in these Terms limits liability for gross negligence, fraud, or willful misconduct.

13. Governing Law & Dispute Resolution

These Terms and Conditions are governed by the laws of the State of Illinois. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Illinois.

Prior to initiating legal proceedings, both parties agree to attempt resolution through good-faith negotiation. Mediation may be requested by either party as an alternative dispute resolution method. Nothing herein waives any rights provided to tenants under the Illinois Residential Landlord and Tenant Act.

14. Modifications to Terms

Sohum Realty reserves the right to update or modify these Terms and Conditions at any time. Material changes will be communicated to active clients via email or written notice at least 30 days prior to taking effect. Continued use of our services following notice of changes constitutes acceptance of the updated Terms.
